Introduction Aero‑Dash (“Aero‑Dash,” “we,” “our,” or “us”) operates a peer‑to‑peer logistics platform that connects individuals who want to send small items (“Senders”) with individuals who are already travelling and are willing to carry those items (“Pilots” or “Travellers”). These Terms & Conditions (“Terms”) form a legally binding agreement between you (whether as a Sender, Pilot or visitor) and Aero‑Dash. By accessing or using our website, mobile application or services (collectively, the “Platform”), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Platform. IMPORTANT: Aero‑Dash is not a courier, freight forwarder or carrier. We provide a technology platform to facilitate connections between Senders and Pilots. While we strive to provide a safe and reliable service, we are not liable for loss of, or damage to, items. You agree that you use the Platform at your own risk and you should consider insurance or additional protections for valuable items. 2. Eligibility & Account Registration 1. Eligibility. You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. By creating an account, you represent and warrant that you meet these requirements. 2. Account Creation. To access certain features, you must create an account and provide accurate, current and complete information. You agree to update your information to keep it accurate and complete. You are responsible for safeguarding your password and for activities that occur under your account. 3. Verification. We may require identity verification, travel documentation or other information to verify your eligibility and compliance with our policies. You authorise us to make inquiries (directly or through third parties) to verify your identity. 3. Description of Services 1. Connecting Senders and Pilots. Aero‑Dash allows Senders to post details about items they wish to send (including origin, destination, date and description) and allows Pilots to offer to carry items along their existing travel routes. When a Sender accepts an offer from a Pilot, an agreement is formed between the Sender and the Pilot. 2. Payment & Escrow. Senders pay for deliveries via the Platform. We hold payments in escrow and release funds to Pilots after confirmation that delivery has occurred. Aero‑Dash charges a service fee, which is deducted from the payment. 3. Ratings & Reviews. After each completed delivery, Senders and Pilots may rate each other. These ratings help build trust within the community. You agree to provide accurate feedback and refrain from defamatory, abusive or fraudulent statements. 4. User Responsibilities 4.1 Senders • Accurate Information. Senders must provide truthful and complete information about the item, including value, dimensions, weight, contents and destination. Senders must ensure that items are properly packed, labelled and prepared for travel. • Prohibited Items. Senders must not send items that are illegal, dangerous, hazardous, restricted by airlines or carriers, or prohibited under applicable laws (e.g., drugs, weapons, flammable materials, live animals). Senders are solely responsible for complying with customs, import/export and aviation regulations. • Insurance. Senders acknowledge that Aero‑Dash does not provide insurance for items. If a Sender wishes to insure an item, they must arrange their own coverage. • Payment. Senders must pay the quoted fee, including Aero‑Dash’s service fee, prior to pick‑up. Payment will be held in escrow until delivery is confirmed. 4.2 Pilots / Travellers • Compliance with Laws. Pilots must comply with all applicable laws, airline policies and customs regulations. Pilots may not carry items that are illegal, hazardous or restricted. Pilots are solely responsible for any fines, penalties or liabilities arising from transportation of prohibited items. • Safe Handling. Pilots agree to handle items with reasonable care, follow airline baggage guidelines and deliver items to the specified recipient at the agreed location. Pilots should inspect items for compliance before accepting them. • No Alteration of Items. Pilots must not open, tamper with, use or remove items entrusted to them. Items must remain sealed unless opening is required by customs or law enforcement. • Timely Delivery. Pilots should deliver items promptly upon arrival at the destination and confirm delivery through the Platform. Payment will only be released once delivery confirmation is received from the Sender. • Taxes & Reporting. Pilots are responsible for reporting earnings to the relevant tax authorities and complying with any tax obligations. 5. Prohibited Conduct You agree not to: 1. Use the Platform for any illegal or fraudulent purpose. 2. Violate or breach any applicable laws, regulations or airline rules. 3. Send or transport items that are prohibited or restricted by law, airline policies, customs or these Terms. 4. Misrepresent the nature, value or contents of any item. 5. Post false, defamatory or misleading information. 6. Interfere with or damage our Platform, networks or services. 7. Attempt to bypass our identity verification or security measures. 6. Fees & Payments 1. Service Fees. Aero‑Dash charges service fees for facilitating deliveries. These fees may be a percentage of the delivery payment or a fixed amount. Fees are disclosed prior to confirmation. 2. Payment Processing. Payments are processed through third‑party payment processors. Aero‑Dash does not store full payment card details. By using the Platform, you agree to be bound by the terms of our payment processors. 3. Refunds. Our refund policy is set out in a separate document (“Refund Policy”) published on the Platform. 4. Currency Conversion. If payments involve currency conversions, exchange rates may apply. Fees may also apply for cross‑border transactions. 7. Disclaimers & Limitation of Liability 1. Platform Only. Aero‑Dash is a marketplace platform. We do not provide courier or transport services and are not a carrier. We do not control the actions of Senders or Pilots. We make no warranties about Pilots’ ability to transport items or Senders’ ability to send items. 2. No Liability for Loss or Damage. To the fullest extent permitted by law, Aero‑Dash is not liable for any loss, damage, delay, theft or misdelivery of items. Senders and Pilots use the Platform at their own risk. We do not guarantee that items will be delivered undamaged or within a particular time. 3. No Warranty. The Platform is provided on an “as is” and “as available” basis. We do not warrant that the Platform will be uninterrupted, secure or error‑free. 4. Indemnity. You agree to indemnify and hold harmless Aero‑Dash, its directors, employees and agents from any claims, damages, liabilities, costs and expenses arising out of your use of the Platform, your violation of these Terms or your violation of any rights of another. 5. Limitation of Liability. To the extent permitted by law, Aero‑Dash’s total liability to you for any claims arising under these Terms is limited to the greater of (a) AUD 100 or (b) the service fees paid by you in the previous twelve months. 8. Insurance Aero‑Dash does not automatically provide insurance coverage for items. Senders and Pilots are solely responsible for obtaining any insurance they consider necessary. We may, at our discretion, offer access to third‑party insurance products, but we do not act as insurer and are not liable for coverage decisions. 9. Termination 1. Termination by Aero‑Dash. We may suspend or terminate your access to the Platform at any time if we believe you have violated these Terms, engaged in fraudulent or illegal activities or used the Platform in a manner harmful to us or others. 2. Termination by You. You may stop using the Platform and close your account at any time. Any unpaid obligations will survive termination. 3. Effect of Termination. Upon termination, you remain bound by obligations incurred prior to termination, including payment obligations and indemnities. 10. Changes to the Platform and Terms We may modify or discontinue the Platform or change these Terms at any time. We will provide notice of material changes (e.g., via email or through the Platform). Continued use of the Platform after changes constitute your acceptance of the updated Terms. 11. Governing Law & Dispute Resolution 1. Governing Law. These Terms are governed by the laws of Western Australia. You agree to submit to the non‑exclusive jurisdiction of the courts of Western Australia. 2. Informal Resolution. Before initiating legal proceedings, you agree to contact us to attempt to resolve any disputes amicably. If a dispute cannot be resolved within 30 days, either party may pursue formal dispute resolution. 12. Miscellaneous 1. Entire Agreement. These Terms constitute the entire agreement between you and Aero‑Dash regarding the use of the Platform and supersede any prior agreements. 2. Severability. If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. 3. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction. 4. Contact Information.
